SB 9 requires that an applicant utilizing the urban lot split provisions submit an affidavit stating that they "intend to occupy" one of the units constructed on one of the resulting lots for at least three years after the approval of the application for parcel map for urban lot split. This is a sample affidavit that jurisdictions can provide to SB 9 applicants to complete with their application for an urban lot split.
B 9 may not be used on parcels where a current or prior owner has exercised their rights under Government Code § 7060, et. seq, to withdraw accommodations for rent or lease within 15 years prior to the date of the submission of a SB 9 application. SB 9 also provides that the project may not propose to alter or demolish housing occupied by a tenant in the last three years. Jurisdictions may provide this sample affidavit that to SB 9 applicants, requiring the applicants to attest that the site of the proposed SB 9 project meets these criteria.
